SC rejects plea to transfer military trial accused to regular jails

Islamabad (Web Desk): The Constitutional Bench of the Supreme Court (SC) on Tuesday rejected a plea made by lawyer Latif Khosa to transfer to transfer detained individuals to regular prisons.

Khosa argued that such a transfer would allow detainees to have meetings with their families, a concern raised by their legal representatives.

The hearing was briefly delayed after the Additional Attorney General requested an adjournment, citing that the Defence Ministry’s lawyer, Khawaja Haris, was unable to attend due to health issues.

The seven-member bench, led by Justice Aminuddin Khan, granted the delay and rescheduled the proceedings for Thursday.

The case at hand involves a petition questioning the validity of trying civilians in military courts.

During the hearing, Khosa’s plea was rejected by Justice Khan, who remarked that the Attorney General had already assured the court that necessary arrangements for family visits would be made.

Justice Khan further stated that the focus should remain on the legal matters at hand rather than procedural concerns.

Later the court postponed the hearing until Thursday, when it is expected to continue addressing the legality and future of military tribunals in civilian cases.

Earlier on Monday, the same Constitutional Bench of the SC rejected petitions seeking to suspend hearings related to the trials of civilians under the Army Act until the court decides on the petitions challenging the 26th Constitutional Amendment.
