Islamabad (Web Desk): The Islamabad High Court (IHC) on Monday ordered to transfer Pakistan Tehreek-e-Insaf (PTI) Chairman and former premier Imran Khan, who is imprisoned in Attock jail in the cipher case, to Adiala Jail.
IHC Chief Justice (CJ) Aamir Farooq presided the hearing of a petition submitted by the former prime minister’s lawyers regarding his shifting from the Attock to Adiala Jail.
During the hearing, Justice Aamir Farooq remarked that Chairman PTI is an under-trial prisoner in the Cipher case. He said that all the under-trial prisoners in Islamabad are kept in Adiala Jail.
The CJ questioned Additional Attorney General Manoor Iqbal Dogal why the under-trial prisoner was kept in Attock Jail instead of Adiala?. He was kept in Attock Jail in the Tosha Khana case, that sentence has been suspended, if you get transfer to Rahim Yar Khan tomorrow, will you undertake the trial from there?
The court sought the response of additional attorney general on the matter.
In response, the additional attorney general explained that the order to detain the accused in the cipher case at Attock jail had been issued from Attock itself. Justice Farooq clarified that the order originated from Attock because that was where the prisoner had been held.
The IHC CJ said that according to the law, the under-trial prisoner of Islamabad should be in Adiala Jail, and issued the directives to shift PTI Chairman to Adiala Jail.
During the hearing, Khan’s lawyer Sher Afzal Marwat requested the court that PTI Chairman is a sportsman so an exercise machine be provided to him.
CJ IHC said that it was informed that now A, B and C class in the jail has ended.
Barrister Salman Safdar, the lawyer of PTI chairman, said that now there is a normal and better class in the jail, Khan is entitled to a better class.
Justice Amir Farooq said that it is settled that Imrak Khan is entitled to a better class, he is a former prime minister and an educated person and he should get what he is entitled to.
"According to the jail rules, facilities should be given to him the PTI chief and prisoner's rights should not be violated," the IHC CJ remarked.
