Islamabad (Web Desk): The Constitutional Bench of the Supreme Court (SC) on Tuesday accepted to hear a petition filed by Pakistan Tehreek-e-Insaf (PTI) Imran Khan, seeking the formation of a judicial commission to investigate the events of May 9.
The court’s decision followed the resolution of concerns raised by the Registrar's Office about the petition.
The bench, led by Justice Aminuddin Khan, comprised Justices Jamal Khan Mandokhail, Muhammad Ali Mazhar, Syed Hasan Azhar Rizvi, Naeem Akhtar Afghan, and Shahid Bilal Hassan.
Senior lawyer Hamid Khan appeared before the constitutional bench on behalf of the PTI.
During the hearing, Khan argued that Pakistan was effectively under an undeclared form of Martial Law, as there had been no genuine investigation into the May 9 incidents.
He claimed that the military had been repeatedly called in to restore order, bypassing proper legal procedures.
Justice Mandokhail responded by questioning Khan’s broad claim about Martial Law, while Justice Mazhar suggested that Khan should challenge the constitutional provision, Article 245, which authorizes the deployment of the military.
Hamid Khan pointed out that in the aftermath of May 9, hundreds of FIRs had been lodged, and the PTI was facing increasing pressure.
The Assistant Attorney General (AAG) emphasized that the petition's claim of serving the public interest had not yet been fully addressed in the proceedings. In response, Justice Aminuddin clarified that the focus of the current hearing was limited to procedural issues, and not on the core merits of the case.
When questioned why the matter had not been taken up with the high court, he explained that it was a national issue, and the Registrar's Office had raised objections to the petition.
Justice Aminuddin Khan dismissed the Registrar’s concerns and scheduled a hearing for the case to proceed.
